This writ petition (criminal) has been filed seeking to direct the first respondent to provide adequate police protection for the ingress and egress of vehicles and people to and from the petitioner's company premises and to ensure that no workers assemble illegally within the radius of 500 meters from the petitioner factory premises, indulge in any violent activities, conduct protests, demonstrations or meetings or disrupt manufacturing activities in any manner, pursuant to the petitioner's complaint dated 06.12.2025.
2. Mr.S.Santhosh, learned Government Advocate (Crl. Side) takes notice on behalf of the 1st respondent. In view of the consent expressed by the learned counsel on either side, this writ petition (criminal) is taken up for final disposal at the admission stage itself.
3. Since no adverse order is passed against the 2nd and 3rd respondents, notice to the 2nd and 3rd respondents is dispensed with. 2/6
4. The case of the petitioner is that it is engaged in the business of production of pharmaceutical items and medicines. While so, on 16.01.2025, a fatal accident occurred during the company's operations and after enquiry, the petitioner company issued a show cause notice to one Badrachalam on 18.11.2025. Aggrieved by the same, the 2nd respondent union's office bearers approached the petitioner company and demanded to impose minimum punishment against the erring employee and the 2nd respondent union also gave a warning that if the petitioner management decides to take strict disciplinary action, they would resort to a strike. Further, according to the petitioner, the 2nd respondent union is also adopting illegal means, including preventing the ingress and egress of vehicles and machinery to and from the petitioner company's premises.
Therefore, in order to ensure smooth functioning of the factory and to avoid further disruption, the petitioner made a complaint before the 1st respondent on 06.12.2025, seeking necessary police protection. However, till date, no action has been taken by the first respondent on the said complaint. Hence, this petition.
5. Learned counsel for the petitioner would submit that the 2nd respondent and its members are indulging in unfair and illegal activities and are preventing ingress and egress of personnel and machinery to and from the factory premises 3/6
of the petitioner. He would further submit that though the petitioner has no objection in the 2nd respondent and its men, conducting demonstrations or meeting 500 meters away from the factory gate, their only concern is that ingress and egress of men and machinery to and from the petitioner's company should not be prevented by the 2nd respondent and its members. Hence, police protection is sought.
6. Learned Government Advocate (Crl. Side) appearing for the 1st respondent would submit that in the event of receiving any information regarding breach of peace and law and order, the first respondent will take appropriate action in accordance with law.
7. Considering the aforesaid submissions made by the learned counsel on either side, this Court, without going into the merits of the case, directs the first respondent Police to give adequate protection in the event of disruption/ curtailment of ingress and egress of men/personnel and machinery to and from the petitioner's factory premises. The first respondent shall also ensure that no demonstrating or striking persons assemble illegally in any form within the radius of 500 meters from the main gate of the petitioner's factory premises. 4/6
