O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 109(1), 61(2) of BNS and Section 25(1)(a) of Arms Act in Crime No.487 of 2025 on the file of the respondent Police, seeks anticipatory bail.

The case of the prosecution is that, the defacto complainant in this case was earlier involved in a murder case of one Venkatraj in Crime No.364 of 2025 on the file of the respondent police and he was granted bail in that case; that whileso on 11.11.2025, when the defacto complainant was returning to his home, the petitioner herein, who conspired with other accused to kill the defacto complainant in retaliation to the murder of one Venkatraj came in a car with knives, which was driven by the petitioner herein in a rash manner and hit the defacto complainant; that thereby, the defacto complainant sustained grievous injuries and fracture on his left leg; that thereafter, the defacto complainant was taken to hospital and subsequently the complaint was lodged before the respondent police. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case based on the confession of the co-accused in this case; and that the petitioner is ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent police while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that the petitioner herein has driven the car and attempted to murder by dashing on the defacto complainant; that the defacto complainant sustained grievous fracture on his leg and he was discharged from the hospital; and that the investigation of the case is pending.

I have considered the submissions made on both sides and perused the materials available on record, which reveals that, the petitioner herein has driven the car and hit the defacto complainant and it is a clear case of attempt to murder the defacto complainant. K. RAJASEKAR, J.

Considering the above facts, the nature of injuries sustained by the defacto complainant, the manner in which the occurrence is said to have taken place, this Court is not inclined to grant anticipatory bail to the petitioner.
