ORDER
This Writ Petition has been filed seeking for a direction to the respondents to issue full field patta name transfer of TSLR Extract dated 25.03.2025 for the lands morefully described in the prayer to this writ petition in the name of the petitioner as well as the names of other legal heirs of Late M.Masilamani and Late Kothandapani and subsequently, to survey the abovesaid lands.
2. The learned counsel for the petitioner would submit that the application seeking for the aforementioned relief was rejected by the Zonal Deputy Tahsildar on 28.09.2025. The petitioner claims that thereafter, he has given a representation to the appellate authority, namely the 2nd respondent. He further submits that the said representation may be treated as appeal before this Court.
3. Mr.D.Ravichander, learned Special Government Pleader, accepts notices on behalf of the respondents and he would submit that the Page No.2 of 6
petitioner has to necessarily implead the persons in whose names the patta presently stands for the property morefully described in the prayer to this writ petition.
4. The learned counsel for the petitioner, on instructions, would submit that the petitioner is willing to file an appeal as per the Patta Passbook Act, 1983 before the competent authority, within a time frame to be fixed by this Court, provided a direction is issued to the said competent authority to dispose of the appeal, within a time frame to be fixed by this Court.
5. No prejudice would be caused to the respondents, if the said direction is issued by this Court. This Court is not expressing any opinion on the merits of the petitioner's appeal seeking for the relief as prayed for in this writ petition.
6. For the foregoing reasons, this Court directs the petitioner to submit an appeal as against the order dated 28.09.2025 passed by the Zonal Deputy Tahsildar, rejecting the petitioner's application seeking for the relief as prayed for in this writ petition before the competent Page No.3 of 6
authority, namely the 2nd respondent, within a period of two (2) weeks from the date of receipt of a copy of this order, as per the procedure contemplated in the Patta Passbook Act. On receipt of the said appeal, the 2nd respondent shall pass final orders on merits and in accordance with law, after hearing the objections of the persons in whose names the patta for the property presently stands and any other third party, whom the 2nd respondent deem fit to enquire, within a period of twelve (12) weeks thereafter.
7. With the aforesaid directions, this Writ Petition is disposed of. There shall be no order as to costs.
