ORDER
(Order of the Court was made by S.M.Subramaniam J.) Writ of mandamus has been instituted challenging the notice issued by the Executive authority under Section 131(2) and 222 of the Tamil Nadu Panchayats Act, 1994 (hereinafter referred to as "Act").
2. Executive authority identified encroachments in the panchayat property and initiated eviction proceeding. 15 days time line is granted to encroachers to vacate the panchayat property.
3. Learned counsel for the petitioner would submit that a written statement has been filed in response to the notice by the petitioner.
4. On receipt of any such representation, Executive Authority shall consider the same and thereafter, take a decision and submit a report to the jurisdictional Tahsildar for initiation of eviction proceedings under the provisions of the Tamil Nadu Land Encroachments Act, 1905. Show-cause initially issued under Section 131(2) of the Act is to be responded by the encroachers, and in the present case, explanations are submitted. Therefore, Executive authority, after considering the representation, shall take a decision and submit a report for initiation of eviction proceedings.
5. In view of the said position, relief as such sought for in the present writ petition to set aside the show-cause notice cannot be granted.
