O R D E R

The above Writ Petition has been filed seeking to quash the proceedings of the 1st respondent dated 29.10.2025 in R.O.C.No.4286/WC/A3/2025.

2. The petitioner' contention is that he had come into contact with the 2nd respondent through the Bharath Matrimony website and later through Instagram. The petitioner was invited by the 2nd respondent to Chennai in order to get to know each other and to explore the possibilities of getting married. After meeting the 2nd respondent, he had developed serious doubts about their compatibility and therefore, he had immediately informed the 2nd respondent that the relationship could not be extended further. It is the further contention of the petitioner that his refusal hurt the pride of the 2nd respondent, who thereafter started initiated one proceedings after another, alleging that the petitioner had given a false promise of marriage and cheated him. A complaint was filed on 15.02.2025 before the Assistant 2/6

Commissioner of Police, District Special Branch, who, after investigation, had closed the case as "Mistake of fact". Thereafter, the 2nd respondent had given a complaint before the All Women Police Station, St.Thomas Mount, Chennai for offences under Section 69, 351(3), 75(1)(i) and (ii) of BNS for which, the police had registered an F.I,R in Crime No. 4 of 2025 and the same was pending trial before the Mahila Court at Chengalpet. The petitioner had challenged the said proceedings before this Court in Crl.O.P.No.28844 of 2025 and Crl.M.P.No.19531 of 2025 in which he had obtained an order of stay. That apart, the 2nd respondent had filed W.P.No.13237 of 2025 before this Court and later withdrew the same.

3. The petitioner would further submit that the 2nd respondent had lodged a complaint before the K8, Arumbakkam Police Station where the petitioner was directed to appear for enquiry. It appears that the said complaint was closed after enquiry. Thereafter, the 2nd respondent had made a complaint alleging dowry harassment before the District Welfare Board in R.O.C.No.912 of 2025 impleading the petitioner's parents and sister. The petitioner appeared before the Welfare Officer and the complaint was thereafter closed. Finally, after all these proceedings, the petitioner had approached the 1st respondent with the very same set of facts and the 1st 3/6

respondent had passed the impugned order. Challenging the same, the petitioner is before this Court.

Today, when the matter is taken up for hearing, the learned counsel for the 1st respondent would submit that the order which is now impugned is merely a piece of evidence and is not a final order inasmuch as the 1st respondent has only closed the complaint filed by the 2nd respondent herein. Though the complaint was closed by the 1st respondent, a recommendation was made to the police to take appropriate action based on the complaint. Therefore, there is no order passed against the petitioner.

5. Recording the above submission, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 06.01.2026 Index : Yes/No Speaking Order : Yes / No srn 4/6
