ORDER
This writ petition is filed to direct the respondents 1 & 2 to release the death cum retirement benefits of the petitioner's late husband Mr.Vanathaiyan to the petitioner and to the fourth respondent equally and grant family pension to the petitioner and further direct the third respondent to permit the petitioner to withdraw 50% of the amount accrued in Acc.No.10962525442.
2. Since no adverse order has been passed, appearance of the third respondent is dispensed with.
3. The case of the petitioner is that the petitioner married one Mr.Vanathiyan, who worked as Health Inspector in the office of respondents 1 & 2. Unfortunately, he died on 17.08.2024. Since he was having account in the third respondent Bank, all his salaries were remitted in the said account. But, the petitioner was not permitted to withdraw the money from the account, seeking legal heir certificate. Under these circumstances, the petitioner submitted a legal heir certificate, issued by the competent authority, showing the petitioner and the fourth respondent (adopted daughter of Mr.Vanathiyan) as legal heirs of Mr.Vanathiyan. Therefore, the petitioner and the fourth Page No.2 of 5
respondent are entitled to withdraw the money from the said account and to inherit the movable and immovable properties of the Mr.Vanathiyan. Though the petitioner has submitted a legal heir certificate, the respondents have not taken any action. Hence, she submitted a representation before the respondents 1 & 2, in person, seeking terminal benefits. However, the same was not considered till date. Hence, the petitioner has come forward with the present writ petition.
4. Though very many grounds have been raised in this writ petition, learned counsel for the petitioner submits that it would suffice, if this Court, issues a direction to the respondents 2 & 3 to consider the petitioner's representation, as expeditiously as possible.
5. Learned Government Advocate appearing for the respondents 1 & 2 submits that, the petitioner's representation will be considered and appropriate orders will be passed within a time frame that may be stipulated by this Court.
6. Heard the learned counsel on either side and perused the materials available on record.
7. Considering the limited relief sought by the learned counsel for the Page No.3 of 5
petitioner, this Court, without going into the merits of the case, directs the respondents 2 & 3 to consider the petitioner's representation and pass appropriate orders, on merits and in accordance with law, within a period of six
(6) weeks from the date of receipt of a copy of this order.
