For Petitioner : Mr.M.Murali Vinodh For Respondent : Mr.S.Balaji Government Advocate (Crl.Side) C O M M O N O R D E R These Criminal Miscellaneous Petitions have been filed to suspend the sentence imposed on the petitioner in C.C.No.23 of 2021 by the learned Special Metropolitan Magistrate Land Grabbing Court No.II, Egmore, Allikulam, Chennai, on 27.04.2023 by confirming the same in C.A.No.285 of 2023 dated 06.08.2025 on the file of the learned III Additional Sessions Judge, Chennai and to exempt the petitioner from surrendering before the Trial Court, pending disposal of the above revision.
2. The petitioner/accused No.7 in C.C.No.23 of 2021 was convicted by the Trial Court by judgment dated 06.08.2025 for the offences under Sections 120(B) r/w 467, 109, 467 r/w 109, 468 r/w 109, 419 r/w 109, 474 r/w 109, 420 r/w 109 of IPC and Section 465 r/w 109 of IPC and sentenced as mentioned below:

Offence under Section Sentence imposed 120(B) r/w 467, 109, 467 r/w 109, to undergo 3 years simple imprisonment for each offence and to pay a fine of Rs10,000/- for each offence and thus, a total fine amount of Rs.60,000/- in default, to undergo 4 weeks of simple imprisonment 468 r/w 109, 419 r/w 109, 474 r/w 109, 420 r/w 109 of IPC 465 r/w 109 of IPC To undergo 2 years simple imprisonment and to pay a fine of Rs.10,000/- in default, to undergo 2 weeks of simple imprisonment Section 357(1)(b) of Cr.P.C the petitioner along with A3 and A6 were directed to pay compensation jointly or severally a sum of Rs.10,00,000/- to the defacto complainant Aggrieved by the same, he filed Crl.A.No.
27 of 2026 before this Court along with the instant criminal miscellaneous petitions seeking suspension of sentence and for exemption from surrendering before the Trial Court. 3.The gist of the allegation is that the petitioner who was working as Junior Assistant in the Housing Board, entered into a conspiracy with other accused and executed a sale deed in the name of one Kamaraj, S/o.Ganesan by creating false documents.

4.The learned counsel for the petitioner would submit that the coaccused who was working as Superintendent in the Housing Board, had filed a revision in Crl.R.C.No.1969 of 2025 and this Court had suspended his sentence by an order dated 10.10.2025; and that the petitioner is similarly placed and the petitioner had raised substantial ground in the above revision and hence, prayed for suspension of sentence imposed on the petitioner and to exempt the petitioner from surrendering before the Trial Court . 5.Heard the learned Government Advocate (Crl.Side) appearing for the respondent and perused the materials available on record.
6. Admittedly, the sentence of the similarly placed co-accused has been suspended by this Court on 10.10.2025 in Crl.R.C.No.1969 of 2025. The petitioner has raised substantial grounds in the above revision. Considering the above facts and circumstances of the case, this Court is inclined to grant the relief of suspension of sentence to the petitioner and exempt the petitioner from surrendering before the Trial Court, subject to the following conditions:. 4 / 6
(i)The petitioner shall execute a bond for a sum of Rs.25,000/-, with two sureties, each for a like sum to the satisfaction of the learned Special Metropolitan Magistrate for trial of Land Cases No.II, Egmore, Allikulam, Chennai;
(ii)The petitioner and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Trial Court may obtain a copy of their Aadhar card or Bank pass Book and mobile numbers to ensure their identity; and (iii)The petitioner shall appear before the Trial Court on the first working day of every month at 10.30 a.m. until the disposal of the appeal and if he is not able to appear before the Trial Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C. and shall appear before the Trial Court on any other day in lieu of the date of his absence, as directed by the Trial Court.
