The present Criminal Original Petition has been filed seeking to quash the proceedings in Crime No.204 of 2025, pending on the file of the first respondent Police.

The case of the prosecution is that due to a land dispute involving his brother's neighbours, the de facto complainant attempted to mediate. Later, on 24.10.2025, at about 6.40 p.m., the petitioner, along with others, assaulted the de facto complainant using abusive language, stones and physical violence. Therefore, a case in Crime No. 204 of 2025 was registered by the respondent Police for the offences under Sections 296(b), 115(2), 118(1) and 351(3) of BNS, 2023.

Learned counsel appearing for the petitioner submitted that the petitioner was merely a spectator and that a false complaint has been foisted against him.

Learned Government Advocate (Crl.Side) appearing for the first respondent Police submitted that the present case was registered based on the specific overt acts attributed to the petitioner. It was submitted that the petitioner caught hold of the hands of the victim, while the 1st accused assaulted him with stones, resulting the victim sustaining injuries. The victim was taken to hospital and treated as outpatient. He further submitted that the investigation is pending.

Heard both sides and perused the materials available on record.

The case has been registered very recently on 24.10.2025. The complainant had made specific allegations as against the petitioner that he had caught hold of the victim and further, the investigation is also in a very nascent stage. Some reasonable time should be given to the respondent to investigate the matter and further, whether the petitioner is a mere spectator or that he actually participated, are matters for trial. 7.

In view of the above, this Criminal Original Petition stands dismissed.
