The petitioner, who was arrested and remanded to judicial custody on 06.01.2026, for the offence punishable under Sections 8(c) read with Section 22(b) of NDPS Act @ under Section 20(b)(ii)(A) & 22(b) of NDPS Act in Crime No.523 of 2024, registered on the file of the respondent, seeks bail. 1/3

2. This is the 5th bail application filed by the petitioner herein. The petitioner for getting bail relied on the deposition of the witnesses recorded before the trial Court. However, this Court is of the view that, any appreciation of evidence and circumstances advanced by both the petitioner and the prosecution at this stage, would amount to rendering findings on merits. Since this Court also being the Appellate Court and since already this Court already considered the bail petition on merits and dismissed, it is appropriate to direct the petitioner to raise the grounds before the trial Court.

3. With the above observations and directions, this Criminal Original Petition is disposed of.
