ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 3(2)(a), 4(1) and Section 5(1) (a) of the Immoral Traffic (Prevention) Act, 1956 in connection with the Cr. No.0243 of 2025, seeks anticipatory bail.

2. The case of the prosecution is that on 25.09.2025, based on the secret information, the respondent police went to the scene of occurrence and conducted a search at a premises located at Nanthivaram Juction, Vandalur Taluk and found the petitioners were involved in prostitution activities. Hence, the case.

3. Learned counsel for the petitioner submitted that petitioner is innocent person, not involved in the brothel and he has been falsely implicated by the respondent police. He further submitted that petitioner is no way connected with the offences as alleged by the prosecution and hence he prayed to grant anticipatory bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and on instruction submitted that the respondent police have secured certain women from the said premises and mobile phones and other materials were also seized during the search. She further raised strong objection stating that investigation in this case is at nasal stage and if the petitioner is granted anticipatory bail at this stage, there is a possibility of abscondance, tampering of witnesses and will hamper the investigation.

5. Heard both sides and perused the materials available on record.

6. Considering the facts and circumstances of the case, nature of offence, over-tact levelled against the petitioner and the stage of investigation, this Court is not inclined to grant the anticipatory bail to the petitioner.
