This Writ Petition has been filed seeking a direction to the respondents to disburse the terminal benefits of the petitioner like pension, commuted value of pension and gratuity along with 18 % interest. 2.The case of the petitioner is that he was appointed as a Lecturer and was promoted as Professor by the year 2001 at the 3rd respondent University. In 2006, the petitioner was specially appointed as Professor in the Department of Information Technology at Bharathidasan Univerity with pay protection and continuation under the Old Pension Scheme, recognising his prior service at Annamalai University as qualifying service for Pensionary benefits. Thereafter, the petitioner resigned from the 3rd respondent University and immediately joined Bharathidasan Institute of Technology, without any break in service. When Annamalai University,
Trichy was established in 2007, the petitioner's services were absorbed without change. Despite superannuation in 2021 and the grant of extension till 2022, the petitioner has not received his terminal benefits such as pension, gratuity, or leave encashment, though pension contributions for his earlier service were duly transferred. Therefore, the petitioner made several representations on 21.04.2025, 14.05.2025, 17.09.2025 and 27.10.2025. He also preferred an appeal to the 2nd respondent on 26.07.2025, with reminder dated 27.10.2025. However, till date, no progress has been made. Despite multiple requests and representations to the respondents, the terminal benefits remain unpaid. Hence, the present writ petition has been filed. 3.
The learned counsel for the petitioner would submit that it would suffice, if a direction is issued to the 1st respondent to consider the petitioner's representation within a reasonable time. 4.The learned Standing Counsel appearing for the 1st respondent would submit that they will consider the petitioner's representation and pass appropriate orders within a reasonable time to be fixed by this Court.
5.Considering the limited request made by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the 1st respondent to consider the petitioner's representation dated 27.10.2025 on merits and in accordance with law and pass appropriate orders, within a period of six (6) weeks from the date of receipt of a copy of this order, 6.With the above directions, this writ petition is disposed of. No costs.
