The applicant/plaintiff has filed this application seeking substituted service by stating that the notice against the proposed respondents 7 and 8 cannot be served because the notice sent to the respondents 6 and 7 were returned as "addressee moved to other City and no such person in the address".

2.In such case, it would have been appropriate if the plaintiff had sought the present address of the respondents 6 and 7 from the very same counsel from whom he had already got the address of the legal heirs and taken efforts to serve the notice to the respondents through regular mode. Without exhausting the avenues to serve notice through regular mode, filing application seeking substituted serve is a pre-matured one.

3.With these observations, this application is dismissed with the liberty given to the applicant to renew the application of the very same kind in the event of not getting the correct address of the respondents 6 and 7 despite all the efforts as stated already has been exhausted. 27-01-2026 Index: Yes/No GSA
