ORDER
The learned counsel for the petitioner would submit that the petitioner is a lady. The petitioner was convicted for the offence under Section 138 of the Negotiable Instruments Act in STC No.12 of 2024 on the file of Fast Track
Magistrate, George Town, Chennai. The petitioner had filed an appeal in CA No.634 of 2025 and an application in Crl.M.P.No.1 of 2025 before the V Additional (TADA) City Civil and Sessions Judge, Chennai. The Appellate Court, by order dated 08.05.2025 was pleased to suspend the sentence on condition the petitioner deposits Rs.3,00,000/- to the credit of S.T.C.No.12 of 2024 on the file of the Trial Court. The petitioner, being a housewife, was unable to mobilize the amount and hence, she had filed an application seeking extension of time in Crl.M.P.No.8255 of 2025, whereas, the learned Appellate Judge, by order dated 20.11.2025, had dismissed the application.
2. The learned counsel for the petitioner would submit that the petitioner is now ready to comply with the condition and co-operate for the speedy disposal of the appeal and hence, time may be extended.
3. Taking into consideration the submissions made, the time granted in Crl.M.P.No.1 of 2025 vide order dated 08.05.2025 is extended till 12.01.2026. The petitioner shall deposit the amount of Rs.3,00,000/- to the credit of S.T.C.No.12 of 2024 on the file of Trial Court, on or before 12.01.2026. In the event of the petitioner not depositing the amount on or before 12.01.2026, this order shall get automatically lapsed.
4. With the above directions, the Criminal Original Petition stands disposed of.
