Patta No.118 and all subsequent entries issued in the names of Late Kuppusamy and the fifth respondent pertaining to S.F.No.262 / 1 A, Valayampattu Village, for being fraudulently obtained and viod ab initio and consequently direct the 1st Respondent to conduct a detailed enquiry and issue a fresh consolidated patta reflecting the undivided rights of all lawful legal heirs of late Balakrishnan Gounder in S.F.No.262 / 1A and to consider to dispose of the petitioner's representations dated 06/08/2025 and 21/11/2025 within a time frame to be stipulated by this Honorable Court.

ORDER

This writ petition has been filed seeking for a direction to the first respondent to cancel the patta No.118 and all subsequent entries issued in the names of Late Kuppusamy and the fifth respondent, for the property morefully described in the prayer to this writ petition, based on the petitioner's representations dated 06.08.2025 and 21.11.2025, within a time frame to be fixed by this Court.

2.The petitioner claims that erroneously patta No.118 has been issued in favour of the fifth respondent for the property, morefully described in the prayer to this writ petition and he seeks for cancellation of the same through his representations dated 06.08.2025 and 21.11.2025 for the said purpose. Since the same have not been considered, the petitioner has filed this writ petition.

3.Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of the respondents 1 to 4.

4.Learned counsel for the petitioner would submit on instructions that he would be satisfied if a direction is issued to the first respondent to consider the petitioner's representations seeking for cancellation of patta No.118 alone and he would submit that depending upon the decision to be taken by the first respondent on the said representations, liberty may be granted to the petitioner to file appropriate proceedings to prevent any further registration with regard to the property. The said statement made by the learned counsel for the petitioner is recorded.

5.No prejudice would be caused to the respondents 1 to 3 if the petitioner's representations seeking for cancellation of patta No.118 is considered, on merits and in accordance with law, after hearing the objections of the fifth respondent and any other third party whom the first respondent deems it fit to enquire, within a time frame to be fixed by this Court. 6.This Court is not expressing any opinion on the merits of the petitioner's representations. Since no adverse order is being passed against the fifth respondent, notice to the fifth respondent is dispensed with.

7.For the foregoing reasons, this writ petition is disposed of by directing the first respondent to pass final orders, on merits and in accordance with law on the petitioner's representations dated 06.08.2025 and 21.11.2025 seeking for cancellation of patta No.118 and all subsequent entries issued in the names of late Kuppusamy and the fifth respondent for the property morefully described in the prayer to this writ petition, after hearing the objections of the fifth respondent and also any other third party whom the first respondent deems it fit to enquire, within a period of 12 weeks from the date of receipt of a copy of this order. Depending upon the decision to be taken by the first respondent on the representations dated 06.08.2025 and 21.11.2025 given by the petitioner, the petitioner is granted liberty to file appropriate proceedings seeking to prevent any further registration by the third parties in respect of the property, morefully described in the prayer to this writ petition. No costs. Consequently, connected WMP is closed.
