ORDER
This writ petition is filed to direct the first respondent to consider and dispose of the representation dated 30.04.2024 within a limited time frame with regard to the appointment as Assistant Manager by transfer from Ministerial Service.
2. By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.
3. The case of the petitioner is that he was appointed as Fisheries Assistant on compassionate ground in the respondent department on 18.06.2012. Though the petitioner has possessed the higher qualification, he was given appointment only to the post of Fisheries Assistant, which is a violation of G.O.Ms.No.1499, Labour and Employment Department, dated 03.08.1989. Hence, he sent several representations to the respondents and also filed writ petition before this Court, seeking appointment to higher post. Despite which, his claim was not considered by the respondents. Therefore, the petitioner has sent another representation dated 30.04.2024 to the first 2/6
respondent seeking appointment as Assistant Manager by transfer of service, as he possess the prescribed qualification. However, the said representation was not considered, as on date. Hence, the petitioner has come forward with the present writ petition.
4. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the first respondent to consider the petitioner's representation dated 30.04.2024.
5. Learned Additional Government Pleader appearing for the respondents would submit that the petitioner's representation dated 30.04.2024 will be considered and appropriate orders will be passed within a time frame that may be fixed by this Court.
6. Heard the learned counsel on either side and perused the materials available on record.
7. Considering the limited relief sought by the learned counsel for the petitioner, this Court without going into the merits of the case, directs the 3/6
first respondent to consider the petitioner's representation dated 30.04.2024 and pass appropriate orders on merits and in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order. With the aforesaid direction, this writ petition stands disposed of. No costs.
