ORDER

The Petitioners, who were arrested and remanded to judicial custody on 16.11.2025 for the offences punishable under Sections 8(c) 20(b)(ii)(B), 25, 22(b), 29(1) of the NDPS Act, 1985 in Crime No.372 of 2025, on the file of the respondent, seeks bail.

2.The case of the prosecution is that when the respondent police was on a routine checkup, they found the petitioner along with other accused were in possession of 5.200 grams of Kanja and 300 Nos of Nitrazscen tables. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the quantity involved in this case is intermediate quantity and he is in judicial custody from 16.11.2025. Hence, he prayed to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that there is one previous case pending against the petitioner and also submitted that this Court has granted bail to the co-accused in Crl.O.P.No.35664 of 2025 on 26.12.2025. However , he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

Considering the submissions of the learned counsel on either side, the fact that the quantity involved in this case is intermediate quantity and this Court has granted bail to the co-accused in Crl.O.P.No.35664 of 2025 on 26.12.2025 , this Court is inclined to grant bail to the petitioner on certain conditions.

Accordingly, the petitioner is ordered to be released on bail on her executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum to the satisfaction of the learned IX Metropolitan Magistrate Saidapet at Chennai and on further conditions that:- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

[b] the petitioner shall report before the IX Metropolitan Magistrate Saidapet at Chennai daily at 10.30 a.m., for a period of three weeks and thereafter, as and when required for interrogation by the respondent police.

[c] the petitioner shall not abscond either during investigation or trial;

[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court

himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]; [f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S. 05.01.2026 smn Note:
