Mr.Mohamed Fayaz Ali Standing Counsel COMMON ORDER These writ petitions have been filed by the petitioners seeking to direct the respondents to reconsider the rejected vehicles offered by the petitioner in tender No. 2500022836/HD-09050 (RFQNO.5100022836) issued by the 1st respondent by considering the reply dated 06.12.2025 submitted by the petitioners through online portal before issuance of letter of acceptances in respect of the above tender.
2.Mr.Mohamed Fayaz Ali, learned Standing Counsel takes notice on behalf of the respondents. By consent of both parties, these writ petitions are taken up for final disposal at the admission stage itself. 3.Learned counsel for the petitioner would submit that tender has been called for by the 1st respondent on 01.10.2025, for transportation of LPG
cylinders. Though the petitioners participated in the tender, some of their vehicles are rejected by the 3rd respondent. In response, the petitioners submitted their reply on 06.12.2025, requesting the respondents to reconsider the rejected vehicles offered by the petitioners. Since their replies were not considered, these writ petitions have been filed.
4.Learned Standing Counsel appearing for the respondents would submit that these writ petitions are not maintainable since the condition prescribed in Page No.26 of the E-tender dated 01.10.2025 states that the Courts in the city of controlling Regional Office alone shall have jurisdiction to entertain any application or other proceedings in respect of anything arising under this tender either before or after or during the finalization of the tender and hence, prayed to dismiss the present writ petitions.
5.Heard the learned counsel for the petitioners as well as the learned Standing Counsel appearing for the respondents and perused the materials available on records.
6.Considering the submissions made by either parties, this Court is of the view that when the tender condition itself indicates that the Courts in the city of controlling Regional Office alone shall have jurisdiction to entertain any application or other proceedings in respect of anything arising under this tender,
as a matter of right the petitioner cannot challenge the rejection orders passed by the 3rd respondent before this Court.
7.In view of the above, these writ petitions are not maintainable before this Court. The petitioners shall challenge the rejection orders passed by the 3rd respondent before the jurisdictional Court, if so advised. Accordingly, these writ petitions are dismissed. No costs.
