O R D E R
This Writ Petition has been filed seeking a direction to the respondents to pay interest of 10% to the petitioners for the belated payment of gratuity, leave salary, provident fund and commutation of pension amounts and 10 days earned salary with effect from 21.05.2024 to 31.05.2024, 21.06.2024 to 30.06.2024, 21.07.2024 to 31.07.2024, within a time frame as fixed by this Court.
2. It is the case of the petitioners that they joined the services of the first respondent Corporation and had retired from service during 2023-24. However, the gratuity, leave salary, provident fund and commutation of pension amounts and 10 days earned salary with effect from 21.05.2024 to 31.05.2024, 21.06.2024 to 30.06.2024, 21.07.2024 to 31.07.2024 have been settled only after 6 to 22 months. Therefore, the petitioners claimed 10% interest on the belated settlement of retirement benefits and they also made representations on 27.11.2025 to 08.12.2025 to pay interest for the belated settlement of retirement benefits which have not evoked any response so far. Hence, the present Writ Petition.
3. Heard the learned counsels appearing on either side and perused the materials available on record. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.
4. In view of the limited request made by the petitioners with regard to interest on the belated settlement of retirement benefits, this Court directs
the respondents to pay interest at the rate of 6% p.a. for the belated payment of retirement benefits from the date of retirement till the date of actual disbursal of the retirement benefits of the petitioners and also to consider the issue in regard to disbursement of the earned salary as stated supra, if there is no other impediment in disbursing the same, within a period of six weeks from the date of receipt of a copy of this order, taking into account the bank rate of interest on deposits.
5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
