ORDER

The petitioner, who was arrested and remanded to judicial custody on 09.06.2025 for the alleged offence under Section 406, 420, 468, 471 of IPC in CC.No.321 of 2025 in Crime No.26 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner, by giving a false promise to secure job at Neyveli (NLC) for the post of INDCOSERV (contract worker), had collected a sum of Rs.72.00,000/- from several persons, including the defacto complainant. However, he neither secured the promised employment nor returned the money. Hence the present complaint was registered against the petitioner.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that the petitioner has been in judicial custody since 09.06.2025. He further submitted that if the petitioner is released on bail, he would settle the entire money payable to the defacto complainant and in this regard, affidavit was also filed. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent Police reiterated the prosecution case and submitted that the charge sheet has been filed, and the case has been taken on file in C.C.No.321 of 2025 on the file of the District Munsif Cum Judicial Magistrate Kurunjipadi. He further submitted that the petitioner is not only in involved in this case but also having 8 other cases and 4 cases are similar in nature and is also facing a trial in those cases also. Hence, he opposed to grant bail to the him.

Considering the fact though now the petitioner claim that he is ready to pay and settle the money payable to the defacto complainant in this case, the facts remains that the petitioner is involved in 4 similar cases and in those cases, the petitioner is facing trial and he could not settle money to all the persons. Considering the gravity of the offences involved in this case and bad antecedents and if the petitioner is released on bail, there is likelihood that he will indulge in similar offences, hence, this Court is not inclined to grant bail to the petitioner.
