ORDER

This Criminal Miscellaneous Petition has been filed to suspend the

conviction and sentence passed by the learned District and Sessions Judge (Fast Track Court) Thirupathur, Thirupathur Division, in S.C.No.49 of 2024 dated 25.09.2025 pending disposal of the above criminal appeal.

2. The petitioner/Accused in S.C.No.49 of 2024 was convicted and sentenced by the Trial Court by judgment dated 25.09.2025 as follows: under Section Sentence imposed 376(2)(1)(n) of of IPC To undergo RI for 10 years and to pay a fine of Rs.3,000/-, (i.d) SI for 3 months.

3. Aggrieved by the same, the petitioner filed Crl.A.No.1938 of 2025 before this Court along with the instant miscellaneous petition seeking suspension of sentence and bail.

4. The case of the prosecution is that the petitioner is the friend of the victim's father had committed rape on the victim girl, who is blind, on several occasions and on the date of complaint, the petitioner was got red-handed by her relatives.

5. On perusal of the evidence on records, this Court finds that the evidence of the victim inspires confidence and there is no reason to suspend the sentence imposed on the petitioner. Therefore, this Court is not inclined to

entertain the application for bail at this stage.
