ORDER

This writ petition has been filed, seeking for survey and demarcation of boundaries as well as for issuance of separate patta for the sub divided property morefully described in the prayer to this writ petition in favour of the petitioner within a time frame to be fixed by this Court.

2. Mr. D. Ravichander, learned Special Government Pleader accepts notice on behalf of the respondents 1 to 3. On instructions, he would submit that the petitioner has not submitted any separate online application for issuance of patta but has submitted an application only for survey and demarcation of boundaries of the property morefully described in the prayer to this writ petition.

3. The learned counsel for the petitioner would now submit that for the present it would suffice if survey and demarcation of boundaries is alone done. The said statement is recorded.

4. No prejudice would be caused to the respondents if a direction is issued to the second and third respondents to survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition after hearing the objections of the fourth respondent as well as any other third party whom the second and third respondents deem it fit to enquire within a time frame to be fixed by this Court.

5. Since no adverse orders are passed against the fourth respondent in this writ petition, notice to the fourth respondent is dispensed with by this Court.

6. For the foregoing reasons, this writ petition is disposed of by directing the second and third respondents to survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition within a period of twelve weeks from the date of receipt of a copy of this order after hearing the objections of the fourth respondent as well as any other third party whom the second and third respondents deem it fit to enquire. After survey and demarcation of boundaries is done by the second and third respondents as stated supra, the petitioner is permitted to file a fresh online application seeking for issuance of separate patta in favour of the petitioner for the sub divided property and the same shall be considered on merits and in accordance with law by the official respondents. No Costs.
