Respondent(s) PRAYER; This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of certiorarified Mandamus, to calling for the entire records which culminated in issuing vide proceedings in Se.Mu.No.B4/323/2024 dated 13.11.2025 on the file of the 3rd respondent and quash the same in so far as the petitioner is concerned and further direction directing the respondent to appoint the cook in BC,MBC Minorities welfare Department, on par with juniors namely K.Ramesh Kumar and 6 others and subsequently appointed namely

B.Karthick and C.Ramani followed by same procedure of law and Article 14 of constitution of India.

ORDER

This petition has been filed seeking to quash the impugned proceedings in Se.Mu.No.B4/323/2024 dated 13.11.2025 on the file of the 3rd respondent and and further direction directing the respondent to appoint the cook in BC, MBC Minorities welfare Department, on par with juniors namely K.Ramesh Kumar and 6 others and subsequently appointed namely B.Karthick and C.Ramani followed by same procedure of law and Article 14 of constitution of India.

2. It is the case of the petitioner that a total of 10 candidates were selected for the post of Cook. Out of them, 7 persons were appointed initially, excluding 3 candidates including the petitioner. Subsequently, in the year 2024, another 2 candidates were appointed to the same post. Except the petitioner, all other candidates were appointed on the basis of the National Disability Card. The same procedure was not followed in the petitioners case and he was not issued with the appointment orders. Hence, the petitioner has requested the respondents to give appointment to him. The first respondent has rejected the petitioners representation and passed the impugned order directing the petitioner

to appear before the Dean, Government Medical College Hospital, Tanjore for assessing the petitioner's disability. Challenging the same, the present writ petition has been filed.

3. The learned counsel for the petitioner submitted that the petitioner is residing at Ariyalur District. However, the respondents has directed the petitioner to appear before the Tanjore Medical College Hospital, which is not sustainable.

4. Heard the learned counsel for both side and perused the materials available on record.

The petitioner has participated in the post of Cook under physically disabled category. As per direction issued by the respondents, the petitioner has to appeared before the Tanjore Medical College Hospital for physical test. However, he has not appeared before it. In order to give last opportunity, this Court directs the petitioner to appear before the Dean, Government Medical College Hospital, Tanjore on 16.02.2026 for assessing the disability and the report shall be forwarded to the third respondent. Upon receipt of the said report, the third respondent shall consider and pass orders on the petitioners representation 06.02.2025 within a period of four weeks from the date of receipt of a copy of this order.

6. With the above directions, the impugned order is set aside and writ petition is disposed of. No costs.
