Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the respondents to pay pension calculating out of 30 days salary instead of calculating 26 days salary, dearness allowance and other benefits to the petitioners and upon considering the petitioners representation dated 16.12.2024 requesting the respondents to change the Pension service by calculating 30 days salary instead of 26 days salary and pay pension accordingly, Dearness Allowance and proper PF amount on par with the staffs retired and other workers retired like in the above spinning mill.

This Writ Petition has been filed seeking a direction to the respondents to calculate and pay pension on the basis of 30 days's salary per month instead of 26 days' salary, along with dearness allowance and other consequential benefits to the petitioners and also seeking further direction to the respondents to consider their representation dated 16.12.2024, requesting revision of the pensionary benefits by adopting 30 days' salary for calculation instead of 26 days' salary, and to disburse pension, dearness allowance , provident fund and other retirement benefits on par with similarly place staff and other workers who retired from the same spinning mill.
2.The case of the petitioners is that the petitioners were joined as unskilled workers on meagre salary in the 2nd respondent Spinning Mill,
namely, the Krishnagiri District Co-operative Spinning Mills Ltd., Uthangarai Taluk, Krishnagiri District, on various dates. After rendering continuous service, the petitioners retired upon attaining the age of superannuation on various dates. However, while settling the pensionary benefits, the respondents calculated the pension on the basis of 26 days' salary per month instead of 30 days' salary, which has resulted in a reduced pension and other retirement benefits, thereby causing grave prejudice to the petitioners. The respondents are liable to calculate and pay the pension on the basis of 30 days' salary instead of 26 days' salary, and to disburse Dearness Allowance, after duly considering the petitioners' representation dated 16.12.2024 wherein the petitioners requested the respondents to revise the pension by calculating 30 days' salary instead of 26 days' salary and to pay pensionary benefits on par with the staff and other workers retired from the same spinning mill.
3.The learned counsel for the petitioners would submit that this Court may be pleased to grant liberty to the petitioners to raise an industrial dispute before the Labour Court, in the manner known to law.
4. Recording the same, this writ petition is disposed of by granting liberty to the petitioner to raise an industrial dispute before the Labour Court or authority, in the manner to law.
