ORDER

This Criminal Original Petition has been filed seeking to quash the First Information Report in Crime No.380 of 2022 on the file of the first respondent.

The case of the prosecution is that due to civil dispute, the petitioner, along with other accused, had attacked the de facto complainant resulting in him sustaining grievous injuries. Hence, the complaint. 3.

The learned counsel for the petitioner submitted that the petitioner is an innocent person and that a false complaint has been lodged against him. He further submitted that on the basis of the complaint given by the petitioner with respect to the very same incident, a case in Crime No.379 of 2022 has already been registered by the respondent Police. Hence, the petitioner seeks quashment of the First Information Report registered against him. 4.

Per contra, the learned Government Advocate (Crl.Side) appearing for the first respondent submitted that the matter pertains to a case and countercase. He further submitted that based on the complaint given by the petitioner, a case in Crime No.379 of 2022 has been registered against her brother-in-law and that her brother-in-law, namely Narasimman, has lodged a countercomplaint, pursuant to which the present complaint has been registered. He further submitted that the investigation in both the cases is being conducted in accordance with PSO 566 and the final report would be filed in both the cases. He also submitted that the incident occurred on the same day and that the de facto complainant had also sustained injuries.

Considering the submissions made on either side and taking note of the fact that this is a case of case and counter-case, this Court directs the respondent to strictly adhere to PSO 566 and to file the final report in both the cases, within a period of two months from the date of receipt of a copy of this order.

With the above directions, this Criminal Original Petition stands disposed of.
