ORDER

This application has been filed by the applicant to grant ad-interim injunction restraining the respondents, their men, their agents and anyone claiming under them from interfering with the functioning of the working committee under the Presidentship of the 1st Plaintiff, pending disposal of the above Suit.

2. The learned Senior counsel appearing for the applicants would submit that the 1st applicant is the President of the 2nd respondent's Tamil Nadu Branch and the applicants filed the Suit for declaration declaring that the election conducted by the respondents/defendants dated 16.11.2025 as null and void and for consequential relief of Permanent injunction restraining the respondents/defendants, their men, agents, anyone claiming under them from

interfering, disturbing with the functioning of the Working Committee under the Presidentship of the 1st Plaintiff and for costs. The governing body of the INTUC is the Working Committee headed by the President of INTUC. 2.1. The 1st applicant TN INTUC is one of the Pradesh Branches of TN INTUC and is governed by the Working Committee of Tamil Nadu INTUC which is an elected body, headed by the President and shall be the highest executive authority of Tamil Nadu INTUC.

2.2. The 1st applicant was for the first time appointed as the President of TN INTUC vide a Notification dated 09.09.2020 issued by the 2nd applicant Central INTUC. As per the said notification, a fresh adhoc Committee replacing the earlier elected Committee was formed under the Presidentship of the 1st applicant, V.R. Jaganathan along with 24 office bearers for various designations. This adhoc Committee was notified to hold office until further directions from the 2nd applicant Central INTUC were issued. After a period of two years from the appointment of Ad-hoc Committee, the TN INTUC on 07.08.2022, convened the 27th Delegates Conference at Madurai and the said conference was convened by the erstwhile Adhoc Committee appointed by the Central INTUC as there was no working committee of the state INTUC functioning then. In the above mentioned 27th Delegates Conference at

Madurai, through a Resolution No.4A dated 07.08.2022, the 1st applicant Mr. Jaganathan was elected as President of the TN INTUC with the approval of the delegates elected including the 1st respondent. The said resolution to elect the 1st applicant Mr. Jagannathan was announced by the President of Central INTUC and the same was accepted by all the delegates. 2.3. The Working Committee under the Presidentship of the 1st applicant V.R. Jaganathan was initially running smoothly. The 1st respondent along with his acquaintances started indulging in various unethical activities against the interest of the trade union. The defendant M. Pannerselvam and his acquaintances who were a part of the earlier Working Committee were relieved from their post and they were not made a part of the newly appointed ad hoc Committee. While so, the said M.

Pannerselvam along with others have approached this Court in C.S. No.226 of 2024 challenging the Notification dated 06.09.2024 and also filed an application to appoint an Election Officer for conducting the upcoming elections for the Working Committee of the TN INTUC which was ought to be due in the month of August 2025. This Court through an order dated 15.07.2025, passed an order that the election ought to be conducted to the INTUC as the office bearers of the Working Committee members since their tenure has lapsed and consequently appointed Hon'ble Mr. Justice S.

the election officer to be incharge of conducting the elections. 2.4. While being so, the 2nd applicant, the Central INTUC on 21.12.2024 conducted its 314th Working Committee meeting at U.R.M.U. New Delhi, wherein a resolution was passed to solve the disputes among the INTUC, Tamil Nadu Branch. The Working Committee of INTUC taking note of the order of this Court authorized the President to dissolve the ad-hoc Committee dated 06.09.2024 and as well as the earlier elected Committee of the Tamil Nadu INTUC. The incumbent President was authorized to appoint a fresh Ad-hoc Committee and within a period of one year, election must be conducted to form a new Working Committee from the date of appointment of the Ad-hoc Committee. On 22.02.

2025, a resolution was passed by the INTUC in the 252nd Working Committee Conference at Dindigul, wherein the President of INTUC was empowered to take necessary decisions regarding the upcoming conference. The earlier order passed by this Court, on 15.07.2025 was challenged through an O.S.A. No.340 of 2025 and the Hon'ble Division Bench of this Court disposed of the appeal with a direction that in any event of procedural violations, the aggrieved person was given liberty to approach the competent forum and the Suit itself was disposed as infructuous and the main order was set aside. The earlier Committee was revived by the 1st applicant with the consultation of the 2nd applicant and already carried out 90% of election work.

The 2nd applicant, Central INTUC issued a letter dated 31.10.2025 to the President of the Tamil Nadu State Branch INTUC approving the Adhoc Committee dated 06.09.2024 to be valid till the forth coming elections or till any further directions from the Central INTUC. Pursuant to the order dated 27.10.2025 in O.S.A. No.340 of 2025 and subsequent developments, the TN INTUC Adhoc Committee, called for an urgent meeting on 31.10.2025, to discuss on the upcoming elections.

2.5. As per the resolutions passed by the Adhoc Committee, the elections have to be conducted for TN INTUC on 15.11.2025 at Madurai and also to appoint national level office bearers as the observers for Tamil Nadu INTUC elections. On the other hand, the members aggrieved by the actions of the TN INTUC, unlawfully and illegally formed a separate election Committee consisting of the 2nd to 5th respondents and in addition, a credential Committee consisting of 6th to 10th respondents was formed with sole purpose to create confusion among the delegates and disturb the elections scheduled by the TN INTUC. The respondents without any authority, issued an unauthorized election notice dated 01.11.2025. A suit was filed challenging the election notification to be held in Madurai at Thiruvallur District. Though the Credential Committee has its official address at Chennai and the place of election is at Madurai, the Suit was filed at Thiruvallur by the Nethaji Auto Ootunar Pothu

Nala Sangam under the instigation of the defendants, by suppressing the material facts. The District Court, Thiruvallur vide its order dated 12.11.2025 granted an interim injunction from conducting election on 15.11.2025. The said order was not communicated to the applicants and these applicants are not parties to the Suit.

2.6. Consequent to the interim injunction, the Election Committee of TN INTUC decided to drop the election through a secret ballot. Instead a general conference was proceeded with the consensus of the delegates. In the said conference a resolution was passed unanimously, appointing the 1st applicant as the President of INTUC and further resolutions were also passed in giving powers to the President to choose other office bearers as per the Constitution of TN INTUC. As per the resolutions passed in the Delegates conference dated 15.11.2025, the 1st applicant was unanimously chosen as the President of TN INTUC and subsequently he assumed charge as the President of INTUC. Therefore, the 1st applicant holds the post of the President of TN INTUC. 2.7. For the said election, approval was also granted by the 2nd applicant, the Central INTUC through an order dated 17.11.2025. On the very next day, i.e., on 16.11.2025, the respondents convened an unauthorized and illegal delegates conference with a participation of a meagre i.e., less than 10% of the

members of the INTUC and claimed to have elected the President of INTUC, which is totally absurd and contrary to the constitution of INTUC. The 1st respondent by claiming himself to be the Secretary General of the TN INTUC convened a Working Committee meeting and without any sanction neither from the TN INTUC nor from the INTUC appointed the election committee and the credential Committee. The said unauthorized Committee conducted an election on 16.11.2025 which is incomplete on contravention to the constitution of the TN INTUC and by virtue of that election, the defendants claimed to be the office bearers of TN INTUC which is completely absurd. Therefore, they filed the Suit and now filed this application. The applicants have prima facie case and balance of convenience is also lying in favour of the applicants and that if injunction is not granted, irreparable loss and damages will be caused to the applicants. Therefore, prayed to grant interim injunction to the applicants.

The learned counsel appearing for the respondent would submit that the first plaintiff was unanimously elected as the president and was given power to nominate other office bearers and the ordinary Working Committee members to the working committee of the Tamil Nadu INTUC and the first respondent was appointed by the first plaintiff to the post of Secretary General of the Working Committee of Tamil Nadu INTUC. The first applicant was unanimously appointed as the President during the 27th Delegate Conference at Madurai, the

fist applicant misusing his official position and usurping its power as President of Tamil Nadu had illegally appointed as many as 144 members as members of Working Committee as against the sanctioned strength of 51 members as provided under the Constitution of Tamil Nadu INTUC. Further when the first respondent herein has been successfully elected as the President of Indian National Engineering Employees Union as Union Affiliated to the Tamil Nadu INTUC, the first respondent herein had raised concerns and voiced against the said illegal activities of the fist applicant and his close aids and instituted suit in O.S.No.99 of 2023 on the file of the learned Principal District Munsif, Ambattur and the same is pending.

3.1. While so the first applicant colluded with the Central INTUC had clandestinely over thrown a democratically elected working committee only to silence the first respondent herein and those people who in support of the first respondent herein by way of removing them through an illegal notification dated 06.09.2024 by appointing adhoc committee for an indefinite period. The said notification dated 06.09.2024 is quite illegal and the same was not issued in accordance with the strict procedures enumerated under the Byelaws of the Central INTUC. The first applicant who is also the President of the adhoc committee was not given power to either add more members to the adhoc committee or removing the existing members in the adhoc committee. Such a

course is quite antithetical to the mandates enumerated under the Constitution of Central INTUC and also Tamil Nadu INTUC. One suit in C.S.No. 226 of 2024 was filed challenging the notification dated 06.09.2024 issued by the Central INTUC and for permanent injunction restraining the defendants therein from interfering with the functions of the plaintiffs therein as respective office bearers of the Tamil Nadu INTUC and this Court granted interim injunction, thereby the first respondent herein was permitted to continue to function as Secretary General of Tamil Nadu INTUC vide interim order dated 27.09.2024. 3.2.The above mentioned interim order granted on 27.09.2024 was later made absolute vide order dated 12.11.2024. Pursuant to the interim injunction granted by this Court in C.S.No.

226 of 2024, the first respondent successfully functioned as Secretary General of INTUC. While so, the first respondent called for working committee meeting on 22.02.2025 at Dindigul without the concurrence of the first respondent who is the Secretary General of the Tamil Nadu INTUC and also the first applicant herein had not invited the plaintiffs therein in the above mentioned suit in CS No.226 of 2024 and thereby they filed an application in OA No.154 of 2025 in CS No.226 of 2024 for an injunction restraining the defendants therein from convening working committee meeting on 22.02.2025 and this Court through order dated 19.02.2025 directed the plaintiff in CS No.

participate in the meeting held on 22.05.2025. The Working Committee meeting dated 22.02.2025 got disrupted due to mischief and ruckus created by the fist applicant herein and his supporters. The first applicant herein filed memo in CS No.226 of 2024 and the same was dismissed as infructuous, on account of the resolution made in 314th Working Committee meeting of central INTUC held at New Delhi on 21.12.2024 3.3.The 314th Working Committee held at New Delhi on 21.12.2024 had resolved to empower President to dissolve the adhoc committee meeting dated 06.09.

2024 and also earlier elected committee and to appoint a fresh adhoc committee to the Tamil Nadu INTUC for a period of one year and the election has to be conducted within a period of one year of appointment of new adhoc committee, however, this Court was not pleased to act upon the said memo and accordingly not dismissed the suit as infructuous. It is also relevant to mention that it has been alleged in the plaint that pursuant to the 314th working committee meeting of Central INTUC held on 21.12.2024, the first applicant had reappointed the earlier adhoc committee appointed under Notification dated 06.09.2024 in Working Committee meeting held at Dindigul. Which is quite contrary to the resolution dated 21.12.2021 and the same is contrary to the Constitution of Central INTUC.

3.4. The plaintiff in CS No.226 of 2024 filed an application in A.No.2203 of 2025 seeking for appointment of Election Commissioner for conducting the elections for the Working Committee for INTUC and the Election Officer was also appointed to conduct elections for the post of President alone and it has been unanimously decided to empower the said elected President to nominate the other officer bearers. Thus, the parties by way of consensus had chosen to revive the elected working committee for the purpose of then upcoming elections that felt due on August 2025. In view of the said consensus, the said suit was disposed vide order dated 15.07.2025. Thereafter, the election officer had decided on the eligibility of the Working Committee members and accordingly shortlisted 139 members in total list of 144 members, furnished by the first respondent herein.

3.5. The affiliated union of Tamil Nadu INTUC challenging the consensual order dated 15.07.2025 in OSA No.340 of 2025 and the Division Bench of this Court allowed the appeal and set aside the consensual order dated 15.07.2025 made in application NO.2203 of 2025 in CS No.226 of 2024 reliving the Election Commissioner appointed therein forthwith. The Division Bench also observed that the election to the Working Committee of Tamil Nadu INTUC shall be conducted following the mandate enumerated under the Tamil

Nadu INTUC Constituents, scrupulously more particularly clause 11 of the said Constitution. As per the orders passed in OSA No.340 of 2025, the Working Committee of the Tamil Nadu INTUC got convened on 31.10.2025 and it has been unanimously decided to conduct the elections for all the 51 posts by way of secret ballot. The first respondent as the General Secretary had convened a meeting with sufficient quorum and election committee was constituted for the purpose of conduction of election and the election committee had fixed the date on 16.11.2025 and based on the election notification nominations have been received and final list of candidates were also published. As only 30 nominations have been received against the sanctioned post of 30 ordinary working committee members, it has been decided to conduct elections only for the post of office bearers comprising of 21 posts. Whileso, the first applicant along with close members/aids had chosen to conduct a parallel elections at Madurai only to upset the democratic elections conducted by the Tamil Nadu INTUC.

3.6. Already a suit has been filed in O.S.No.812 of2025 on the file of the Principal District Court, Thiruvallur, in respect of the election at Madurai and the court also granted interim order in IA No.2 of 2025 in OS No. 812 of 2025. Thereafter, the first applicant was elected as President giving him power to appoint other office bearers and ordinary working committee members in the

working committee of Tamil Nadu INTUC based upon the powers conferred upon during the alleged delegate conference dated 15.11.2025 calling upon to nominate other office bearers and other committee members for approval. When the applicants herein are making challenge to the election dated 16.11.2025, they have made only the first respondent as a part to the proceedings and consciously omitted the other office bearers and other ordinary working committee members who were elected on the said date. The other working committee members who were elected on 16.11.

2025 are both proper and necessary parties to the instant application and failure to array them as the parties in the present application is fatal to the case of the applicants herein and hence the present application has to be necessarily dismissed on the sole ground of non-joinder of necessary parties. The respondents 2 to 10 herein are not residing in the first respondent address. The Central INTUC alone can nominate working committee as per Rule 25 of the Bye law, therefore, once again the same President of the INTUC Cannot nominate the persons and the Central INTUC has proved the list and that list is not in consensus with the order of the Hon'ble Division Bench of this Court.

Therefore, the petitioner is not entitled for the relief of interim injunction and there is no prima facie case case made out for the grant of interim injunction and if any injunction is granted the respondent will be put to heavy loss and damages, therefore, the petition is liable to be dismissed.

4.Heard both sides and perused the materials available on record.

The plaintiffs have filed a Suit for declaration declaring that the election conducted by the defendants dated 16.11.2025 as null and void and for consequential relief of Permanent injunction restraining the defendants, their men, agents, anyone claiming under them from interfering, disturbing with the functioning of the Working Committee under the Presidentship of the 1st Plaintiff and for costs. The governing body of the INTUC is the Working Committee headed by the President of INTUC. The working committee shall conduct the general administration of the Congress and shall be the highest executive authority of INTUC and shall have the power to carry out programs and policies as laid down by the General Council. 5.1.

The 1st applicant TN INTUC is one of the Pradesh Branches of TN INTUC and is governed by the Working Committee of Tamil Nadu INTUC which is an elected body, headed by the President and shall be the highest executive authority of Tamil Nadu INTUC. The 1st applicant was for the first time appointed as the President of TN INTUC vide a Notification dated 09.09.2020 issued by the 2nd applicant Central INTUC.

In the above mentioned 27th Delegates Conference at Madurai, through a Resolution No.4A dated 07.08.2022, the 1st applicant Mr.

Jaganathan was elected as President of the TN INTUC with the approval of the delegates elected including the 1st respondent. The said resolution to elect the 1st applicant Mr. Jagannathan was announced by the President of Central INTUC and the same was accepted by all the delegates. The above said facts are admitted by the both parties. 5.2. According to the applicants, the Working Committee under the Presidentship of the 1st applicant V.R. Jaganathan was initially running smoothly, the 1st respondent along with his acquaintances started indulging in various unethical activities against the interest of the trade union, the defendant M.

Committee were relieved from their post and they were not made a part of the newly appointed ad hoc Committee, In the meantime the said M. Pannerselvam along with others have approached this Court in C.S. No.226 of 2024 challenging the Notification dated 06.09.2024 and also filed an application to appoint an Election Officer for conducting the upcoming elections for the Working Committee of the TN INTUC which was ought to be due in the month of August 2025. This Court on 15.07.2025 passed an order that the election ought to be conducted to the INTUC since the tenure of the office bearers of the Working Committee has lapsed and consequently appointed Hon'ble Mr. Justice S. Vaidyanathan, Former Chief Justice of Meghalaya High Court as the election officer to be incharge of conducting the elections.

The earlier order passed by this Court, on 15.07.2025 was challenged through an O.S.A. No.340 of 2025 and the Hon'ble Division Bench of this Court disposed of the appeal with a direction that in any event of procedural violations, the aggrieved person was given liberty to approach the competent forum and the Suit itself was disposed as infructuous and the main order was set aside. 5.3. The 2nd applicant, Central INTUC issued a letter dated 31.10.

Pursuant to the order dated 27.10.2025 in O.S.A. No.340 of 2025 and subsequent developments, the TN INTUC Adhoc Committee on 28.10.2025, called for an urgent meeting on 31.10.2025, to discuss on the upcoming elections.

5.4. As per the resolutions passed by the Adhoc Committee, the elections have to be conducted for TN INTUC on 15.11.2025 at Madurai and also to appoint national level office bearers as the observers for Tamil Nadu INTUC

elections. On the other hand, the members aggrieved by the actions of the TN INTUC, formed a separate election Committee consisting of the 2nd to 5th respondents and in addition, a credential Committee consisting of 6th to 10th respondents, and also issued an election notice dated 01.11.2025. A suit was filed challenging the election notification to be held in Madurai at Thiruvallur District. The District Court, Thiruvallur vide its order dated 12.11.2025 granted an interim injunction from conducting election on 15.11.2025. The said order was not communicated to the applicants and these applicants are not parties to the Suit.

In the said conference a resolution was passed unanimously appointing the 1st applicant as the President of INTUC and further resolutions were also passed in giving powers to the President to choose other office bearers as per the Constitution of TN INTUC. As per the resolutions passed in the Delegates conference dated 15.11.2025, the 1st applicant was unanimously chosen as the President of TN INTUC and subsequently he assumed charge as the President of INTUC. Therefore, the 1st applicant holds the post of the President of TN INTUC.

5.6. The said election was also approved by the 2nd applicant, the Central INTUC through an order dated 17.11.2025. On the very next day, i.e., on 16.11.2025, the respondents conveyed delegates conference and claimed to have elected the President of INTUC, the 1st respondent by claiming himself to be the Secretary General of the TN INTUC convened a Working Committee meeting appointed the election committee and the credential Committee. The said Committee conducted an election on 16.11.2025 and by virtue of that election, the defendants claimed to be the office bearers of TN INTUC. Therefore, they filed the Suit and now filed this application.

According to the applicant, he was unanimously elected as President of Tamil Nadu INTUC as per resolution passed in delegate conference dated 15.11.2025 and the said election was also approved by the Central INTUC through order dated 17.11.2025. While so, on the very next day, i.e., on 16.11.2025, the respondents conveyed conference and claimed to have elected the President of INTUC. The 1st respondent by claiming himself to be the Secretary General of the TN INTUC convened a Working Committee meeting without any sanction neither from the TN INTUC nor from the Central INTUC. The Central INTUC appointed election committee and credential committee.

According to the first respondent, the first applicant appointed the first respondent as Secretary General and he conducted delegates conference and convened working committee meeting and appointed election committee and credential committee . The said committee election was held on 16.09.2025 and the said elected members are not party to the suit and only the first respondent alone was added as party. Since both the applicant and the first respondent are claiming that they are the President of TN INTUC, that issue has to be decided, after elaborate trial. The applicant/plaintiff filed suit challenging the election notification conducted by the defendants dated 16.11.2025. The respondents have not challenged the election of the applicants dated 15.11.2025.

Now at this stage, without any elaborate trial, the merits of the case cannot be decided, at this stage. The applicant filed suit for declaration of election dated 16.11.2025 by only including few persons and according to the respondent through election dated 16.11.2025, President, Senior Vice President, Secretary General, General Secretary, working committee members have been elected for the above said eight posts and totally 51 persons were elected for various posts. While so, without impleading those persons, the petition cannot be decided and their presence is essential to decide the issue. Therefore, there is no prima facie case made out.

committee members is not vested with the T.N.INTUC President and the central INTUC President alone has power to nominate the members of working committee,. As per the order of this court the working committee constituted by the 1st applicant president of T.N. INTUC was dissolved and again the same person the 1st applicant selected the same person as working committee member and the same was approved by the 2nd applicant Central president of INTUC. Therefore the said contention of the respondent has to be tested through trial. Without elaborate trail the disputed facts cannot be decided in the interlocutory application. Already election was conducted and the competency of the election can be tested in the main suit and at this stage holding of office by the persons cannot be tested and there is no sufficient evidence before this Court and therefore, it is not appropriate to grant interim injunction at this stage, therefore the petition is liable to be dismissed.
