Mr.C. Selvaraj, learned Additional Government Pleader takes notice for the 1st respondent and Ms.P.S. Praba, learned counsel takes notice for the 2nd respondent.

2. It is stated that the petitioner was initially appointed as a Work Inspector and thereafter served in various Municipalities including Dindigul and Ambur. Presently, the petitioner is working as a Junior Engineer in Vellore City Municipal Corporation and due to retire from service on attaining the age of superannuation on 31.12.2025.

While so, shockingly, the 1st respondent has issued the impugned transfer order in Na.Ka.No.26293/2025/GA2 dated 12.12.2025, transferring the petitioner to Villupuram Municipality, hardly a few days prior to his retirement. Aggrieved by the same, this writ petition has been filed seeking quashment of the said transfer order dated 12.12.2025 and for consequential directions.

Learned counsel for the petitioner contended that the impugned transfer order issued to the petitioner is per se illegal and contrary to the Government Orders viz., G.O.(Ms) No.10, Personnel and Administrative Reforms Department, dated 07.01.1994 and Government Letter No.23847/S/981, Personnel and Administrative Reforms Department, dated 05.08.1998, which prohibit transfers of Government servants who are due to retire within a short 2/4
period. He further submitted that due to issuance of such transfer order that too on the verge of petitioner's retirement on superannuation would certainly deprive the petitioner from getting his retirement benefits. Therefore, he prayed for grant of interim stay in the above regard.
5. However, learned Additional Government Pleader appearing for the 1st respondent seeks time to get instructions.
6. Considering the submissions made by the learned counsel for the petitioner, this Court is of the view that the petitioner has made out a prima facie case for grant of interim stay. Accordingly, there shall be an order of interim stay as prayed for.
