ORDER

This Court, while considering the earlier bail application of the petitioner in Crl.O.P.No. 29736 of 2025, vide order dated 02.12.2025, was dismissed on the following grounds:

"6. Considering the above facts, the submissions made by the learned Counsel on either side, the fact that the contraband involved is of commercial quantity, and the requirement to satisfy the twin conditions under Section 37 of the NDPS Act, which remain unsatisfied and though the petitioner is in judicial custody for more than 234 days, and the investigation is recently concluded and the final report is filed and the case is pending for framing of charges, this Court is not inclined to grant bail to the petitioner." 2.The learned Counsel for the petitioner submits that though this Court dismissed the earlier bail application on the ground that the case is pending for framing of charges, so far the trial Court has not framed the charges for the past three hearings.

Hence, the petitioner is incarceration without any progress in the trial. Therefore, he prays bail to the petitioner. 3.I have also gone through the FIR and other connected materials which reveals that the petitioner is in custody from 08.04.2025, and the quantity involved in this case is a commercial quantity.

past three hearings, and the same could not be a valid ground for dispensing with the requirements under Section 37 of the NDPS Act. 4.Considering the nature of allegations levelled against the petitioner; and also without knowing the valid reasons for delaying the trial process or who is responsible for delaying the trial process, I am not inclined to reconsider the bail application of the petitioner and hence the same is dismissed.
