ORDER
This writ petition is filed challenging the impugned communication dated 10.12.2025 passed by the fourth respondent and to quash the same.

Upon perusing the affidavit filed in support of the writ petition and hearing Mrs.V.S.Usha Rani, the learned counsel appearing on behalf of the petitioner and perusing the material records, it can be seen that the petitioner claims to be a tenant and regularly paying rent. However, it can also be seen that an order of eviction has been passed in M.P. No.43 of 2025 in exercise of power under Section 78 of the Tamilnadu HR & CE Act, 1959.
3. It can be seen that the petitioner has already filed a revision petition. Pending the revision petition, the petitioner is also entitled to move an application for interim relief. It is the grievance of the petitioner that before the revision petition is taken up and any interim relief can be considered, the impugned order has been passed seeking to recover the property.
4. Per contra, Mr.K.Karthikeyan, the learned Government Advocate appearing for the first to third respondents would submit that if the petitioner is regular in paying rent, the revisional authority will take up the revision and 2/5
will also consider the question of interim relief in accordance with law.

Since it is averred on behalf of the petitioner that the rent is being regularly paid, this writ petition is disposed of on the following terms: (i) The revision said to have been filed by the petitioner in e-office No.2252739/2025 shall be taken up for hearing by the first respondent and the interim prayer of the petitioner shall also be considered. (ii) Until such time, the revision petition is taken up and the interim prayer is considered in accordance with law, there shall not be any coercive proceedings taken against the petitioner for recovery of possession. After the order is passed by the Commissioner, the parties shall be governed by the order passed by the Commissioner.
(iii) Consequently, connected miscellaneous petition is closed. No costs. 18.12.2025 nsl 3/5
