The petitioner seeks a direction to the respondents to refund the sum of Rs.10,00,000/- payable to the petitioner towards refundable security deposit in the account of the petitioner's Solar Power Plant HTSCNo.039514340016.
2.Heard the learned counsel for the petitioner and Mr.D.R.Arunkumar, learned Standing Counsel, who takes notice for the respondents 1 to 4. 3.By consent of both sides, the matter is taken up for final disposal at the admission stage itself.
4.The petitioner made an application to the respondents for establishment of 1 MW Solar Power Plant and the petitioner also paid refundable security deposit of Rs.10,00,000/-. The petitioner has satisfactorily commissioned the Solar Power Plant on 09.02.2023 and it has 2/5
also been certified by the respondents. After commissioning of the Solar Power Plant, the petitioner claimed for refund of the refundable security deposit of Rs.10,00,000/-. Since there was no response, the petitioner has come forward with the present writ petition.
5.In the considered view of this Court, the petitioner, after having satisfactorily commissioned the Solar Power Plant, which was also certified by the respondents, should be refunded the security deposit and the same has not been done for more than a year. Hence, there shall be a direction to the second respondent to refund the security deposit to the petitioner, within a period of six (6) weeks from the date of receipt of copy of this order. It is made clear that, if the amount is not refunded within a period of six (6) weeks, the same shall be liable to be refunded with interest at the rate of 6% per annum from the date it became payable till the date of actual payment. 6.With these directions, this writ petition is disposed of.
