ORDER
This writ petition has been filed by the petitioner seeking to direct the respondents to refund Rs.8,00,000/- payable to the petitioner towards refundable security deposit in the account of the petitioners Solar Power Plant HTSC No.039514340019.
2.Mr.D.R.Arunkumar, learned Standing Counsel appearing for the respondents takes notice on behalf of the respondents. By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.
3.Learned counsel for the petitioner would submit that the petitioner has made an application to the respondents for establishment of 1 MW Solar Power Plant and the petitioner also paid refundable security deposit. The petitioner has satisfactorily commissioned the Solar Power Plant on 29.03.2023 with 18 days delay and it has also been certified by the respondents vide letter dated
29.03.2023. After commissioning the Solar Power Plant, the petitioner is claiming for the refund of the refundable security deposit of Rs.8,00,000/- out of Rs.10,00,000/- since there was delay of 18 days in commissioning the Solar Power Plant. However, there was on response from the respondents. Hence, the present writ petition has been filed before this Court. 4.Learned Standing Counsel appearing for the respondents would submit that the respondents have to verify the records in this regard and if the petitioner had commissioned the Solar Power Plant within 12 months from the date of issuance of Noted For Record Letter, the entire security deposit made by the petitioner will be returned otherwise, reduction will be made as per the terms and conditions.
5.Heard the learned counsel for the petitioner as well as the learned Standing Counsel appearing for the respondents. 6.Considering the submissions made by either parties and in view of the limited prayer sought for in this writ petition, this Court without going into the merits of the case, directs the respondents to refund the security deposit after verifying the records of the petitioner with regard to the commissioning of the Solar Power Plant, within a period of six weeks from the date of receipt of a copy of this order.
