ORDER

This writ petition has been filed seeking for a direction to the respondents 1 to 4 to dispose of the petitioner's representation dated 10.11.2025. 2.In the said representation, the petitioner has requested the respondents 1 to 4 not to transfer the patta for the property, morefully described in the affidavit filed in support of this writ petition in favour of the fifth respondent. According to the petitioner, the Settlement Deed standing in the name of the fifth respondent is a fabricated document and the same is also the subject matter of a Civil Suit.

3.Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of the respondents 1 to 4.

4.Learned counsel for the fifth respondent would submit that the allegations made by the petitioner in the affidavit filed in support of this writ petition against the fifth respondent are false. She would further submit that

only by virtue of a Settlement Deed executed by the fifth respondent's father, the fifth respondent is seeking for issuance of patta in his name for the property, morefully described in the affidavit filed in support of this writ petition 5.This Court is not expressing any opinion on the merits of the contentions of the learned counsel for the fifth respondent. It is for the Tahsildar to look into the same and decide the issue as to whether the fifth respondent is entitled for patta or not.

6.No prejudice would be caused to the respondents 1 to 4 if a direction is issued to the third respondent to pass final orders, on merits and in accordance with law on the petitioner's representation dated 10.11.2025, after hearing the objections of the fifth respondent as well as any other third party whom the third respondent deems fit to enquire within a time frame to be fixed by this Court. 7.For the foregoing reasons, this writ petition is disposed of by directing the fifth respondent to submit his written objections to the third respondent with regard to the petitioner's representation dated 10.11.2025, which is the subject matter of this writ petition along with the supporting documents, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said objections within the stipulated time, the third respondent shall pass final orders, on merits and in accordance with law on the petitioner's representation

dated 10.11.2025, which is the subject matter of this writ petition and thereafter decide as to whether the fifth respondent is entitled for patta or not for the property, morefully described in the affidavit filed in support of this writ petition, within a period of 12 weeks from the date of receipt of the written objections from the fifth respondent.
