ORDER

O.S.No.555 of 1993 was filed by three individuals against the petitioner and her mother before the District Munsif Court, Tiruchengode. In the said suit, an order of attachment in respect of agricultural land admeasuring 2.27 acres in new Survey No.102/6 was issued. The petitioner asserts that a settlement was reached in course of execution proceedings and that the attachment was raised and the execution petition terminated.

2. In spite of the attachment being raised, learned counsel contends that the impugned order of refusal was issued when the petitioner endeavour to alienate the property.

3. Learned Special Government Pleader accepts notice for all the respondents. He submits that the second respondent may be directed to reconsider the matter.

4. The petitioner has placed on record an order recording proceedings in E.P.No.1 of 2002. The order on 06.10.2003 records that the attachment was raised and that the execution petition was terminated. In view thereof, the impugned order cannot be sustained and the matter warrants reconsideration.

5. Considering the above, this writ petition is disposed of on the following terms:

(i) The petitioner shall submit a fresh request before the second respondent by enclosing certified copies of the proceedings before the District Munsif, Tiruchengode within two weeks from the date of receipt of a copy of this order.

(ii) Within one month from the date of receipt of such representation, the second respondent shall make a neutralizing entry in the register of encumbrance or issue a speaking order in case of refusal. 3/5

(iii) No costs.
