Chennaiyan ..Respondent(s) Prayer: Writ petition filed under Article 226 of the Constitution of India to cancel patta Nos.2750 and 2752 and consequently and direct the 4th respondent herein to restore the patta No.2515 which stood in petitioner name for the property comprised in S.No.493/5 measuring an extent of 19 Ares and S.No.492/2A measuring an extent of 19.50 Ares situated at Chinnathimminayanapalli, Bargur Taluk, Krishnagiri District and further direct the 4th and 5th respondents herein to consider petitioner application bearing 2025/0103/31/425345 dated 16.10.2025.

Mr.D.Ravichander Govt Advocate For R1 to R5 Order This writ petition has been filed seeking for a direction to the official respondents 1 to 5 to cancel patta Nos.2750 and 2752 issued in the name of the sixth respondent for the property, morefully described in the prayer to this writ petition, based on the petitioner's application dated 16.10.2025, within a time frame to be fixed by this Court.
2.Since the application dated 16.10.2025 has been submitted with the
fourth respondent, who is the appellate authority, the Revenue Divisional Officer being the appellate authority is directed to treat the application of the petitioner dated 16.10.2025 submitted with the fourth respondent as an appeal filed before the third respondent if the petitioner is aggrieved by the issuance of two pattas i.e. patta Nos.2750 and 2752 for the property, morefully described in the prayer to this writ petition in favour of the sixth respondent. According to the petitioner, the said pattas were issued illegally by the fourth respondent, without granting an opportunity of hearing to the petitioner. 3.Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of the respondents 1 to 5. Since no adverse order is passed against the sixth respondent, notice to the sixth respondent is dispensed with. 4.
No prejudice would be caused to the official respondents if the petitioner's application dated 16.10.2025, which is now treated as an appeal filed before the third respondent, is considered, on merits and in accordance with law, after hearing the objections of the sixth respondent and any other third party whom the third respondent deems it fit to enquire, within a time frame to be fixed by this Court.
5.This Court is not expressing any opinion on the merits of the petitioner's appeal.
6.For the foregoing reasons, this writ petition is disposed of by directing the third respondent to treat the application dated 16.10.2025 submitted by the petitioner with the fourth respondent seeking for cancellation of patta Nos.2750 & 2752 as an appeal and the first respondent to pass final orders, on merits and in accordance with law on the petitioner's appeal with regard to the petitioner's request for cancellation of patta Nos.2750 & 2752 for the property, morefully described in the prayer to this writ petition, after hearing the objections of the sixth respondent and also any other third party whom the third respondent deems it fit to enquire within a period of 12 weeks from the date of receipt of a copy of this order.
