ORDER
This Writ Petition has been filed seeking to direct the respondents to pass orders on the Appeal Petition filed by the petitioner dated 18.08.2025, against the order of punishment passed by the 2nd respondent in Na.Ka.No.071152/W2/E3/2023 dated 06.06.2025 and to reinstate the petitioner into service in the post of P.G.Assistant (chemistry) with all consequential and other attendant benefits.
2. Mrs.S.Mythreye Chandru, learned Special Government Pleader takes notice on behalf of the respondents.
3. The case of the petitioner is that he was working as a P.G. Assistant (Chemistry) in a Government Higher Secondary School at Thoppur, Dharmapuri District. While so, the second respondent issued a charge memo dated 01.12.2023, alleging that the petitioner was living with one Kalpana from 23.09.2010, during the subsisting of his first marriage with one Geetha.
Subsequently, the second respondent passed final orders in the disciplinary proceedings on 06.06.2025, imposing punishment of compulsory retirement. Aggrieved by the said order, the petitioner preferred an appeal dated 18.08.2025 before the first respondent. However, the said appeal has not been considered till date and therefore, the present Writ Petition has been filed.
4. Learned Counsel appearing for the petitioner submits that it would suffice, if this Court issues a direction to the first respondent to consider the appeal of the petitioner and pass appropriate orders on the same within the time that may be stipulated by this Court.
5. On the above contention, this Court heard the learned counsel appearing for the respondent.
6. In view of the limited relief sought for by the petitioners, this Court without expressing any opinion on the merits of the case, directs the first respondent to consider the petitioner's appeal dated 18.08.2025 and pass appropriate orders on the same in accordance with law within a period of twelve
(12) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and any other interested parties.
7. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
