C O M M O N O R D E R These Civil Revision Petitions have been filed by the legal heirs of the claimants seeking payment out of the compensation amount deposited by the respondent/authority.
2.Heard the learned counsel on either side and perused the materials available on record.
3.The applications were returned citing mismatch in the names of the claimants. The learned counsel for the petitioners would submit that the petitioners have already explained the said mismatch by furnishing the necessary documents.
4.I have perused the orders of return passed in the said applications. The mismatch in the names of the petitioners pertains only to spelling variations and nothing more. The Court below ought to have entertained the applications and, before returning the same, ought to have sought clarification by affording an opportunity to the petitioners to satisfy the Court that they are none other than the legal representatives of 3/6
the original claimants.
5.In the light of the above, the docket orders dated 27.11.2025 passed by the Special Sub Court for LAOP Cases, Tiruvallur, are set aside. The Registry is directed to return the original applications, if filed along with these revisions, within a period of one week from the date of uploading of a copy of this order, after obtaining necessary acknowledgment from the learned counsel for the revision petitioners, so as to enable the petitioners to re-present the same before the Trial Court. Upon such re-presentation, the Trial Court shall number the applications and dispose of the same on merits and in accordance with law, within a period of eight weeks thereafter, after affording an opportunity of hearing to the revision petitioners as well as the respondent.
6. Accordingly, these civil revision petitions are allowed. No Costs.
