This petition has been filed to condone the delay of 12 days in filing the Second Appeal.

2. Learned counsel for the appellants would submit that the Court notice was not served on the respondents 1, 3 to 5 and thereby, this Court by order dated 28.08.2023 ordered notice of substituted service. The petitioners had duly complied by publishing notice in "Dinakaran" on 01.09.2023 and the date of hearing has been mentioned as 15.09.2023.

3. Despite the service of notice on the respondents, there is no representation for the respondents.

4. However, the reasons adduced in the affidavit filed in support of this petition being satisfactory, this petition is ordered and thereby, the delay of 12 days in filing the second appeal is condoned.
