ORDER

The petitioner, who was arrested and remanded to judicial custody on 16.11.2025, for the alleged offence punishable under Sections 118(1), 296(b) of BNS Act @ 109 of BNS Act, in Crime No.489 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the husband of the defacto complainant was having an illicit relationship with the petitioner's wife, and due to the same, on the date of the alleged occurrence, the petitioner stabbed the defacto complainant with a knife and caused severe injuries. Based on the same, a case was registered and the petitioner was arrested.

3. Learned counsel appearing for the petitioner submitted that the injured was treated in the general ward and no serious injuries have been caused and that he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the injured is still in hospital and he had sustained stab injuries, required continuous medical treatment. Hence, he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the fact that the injured is still undergoing treatment and that the investigation is still pending, this Court is not inclined to grant bail to the petitioner.
