ORDER

Respondents 3 to 11 executed a sale deed in favour of the petitioner and the vendors and purchaser presented the same for registration. The request for registration was declined under the impugned order.

2. Learned counsel for the petitioner contends that the reason for refusal is the existence of entries relating to 2 fraudulent documents. Therefore, he contends that the impugned order is unsustainable.

3. Mr.Stalin Abhimanya, learned Additional Government Pleader, accepts notice for respondents 1 and 2. He submits that the petitioner has an alternative remedy under Section 72 of the Registration Act, 1908. He relies on the judgment of the Division Bench of S.Indirani v. The Sub Registrar, 2025:MHC:2668.

4. On perusal of the impugned order, it is evident that it is an order under Section 71. As against such order, as contended by learned counsel for the first and second respondents, an appeal lies under Section 72. Such appeal should have been filed within thirty days from the date of receipt of the impugned order. The petitioner has, however, bona fide presented and prosecuted this __________Page 3 of 5

petition with diligence. In these circumstances, if the petitioner were to present an appeal before the District Registrar concerned within thirty days from the date of receipt of a copy of this order, such appeal shall be received and disposed of on merits without going into the question of limitation.
