Respondent(s) PRAYER; This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Certiorarified Mandamus, quashing the order passed by the 3rd respondent in proceedings letter No.A1/ 5054/ 2016 dated 31.08.2023 rejecting the claim of the petitioner dt.03.05.2022 to set right the pay anomaly and consequently direct the respondents 1 to 3 to revise the pay scale of the petitioner on a par with his junior T.N. Thirumalaivasan with effect from 15.03.2007 and revise the pension pay of the petitioner in such behalf together with arrears payable by sending such proposal to the 4th respondent within time frame.

ORDER

This petition lies on a narrow compass. The relief sought for by the petitioner is revision of his pay scale on par with his junior and accordingly, pay him revised pension from the date of his retirement. According to the petitioner, he joined in Agriculture Department on 26.03.1976 as Agriculture Officer. The petitioner enjoyed subsequent promotions and retired from service on 28.02.2011. According to the petitioner, his junior viz., T.N.Thirumalaivasan, who joined as Agriculture Officer on 03.12.1975 and retired from service on 31.05.2011 was receiving a higher pay-scale and therefore, he was drawing a higher pension. Pinpointing the said pay anomaly, the petitioner has made a representation to the respondents seeking parity of pay-scale with that of his junior.

The request of the petitioner was negatived by the third respondent vide order dated 31.08.2023 holding that though the petitioner was promoted as Assistant Soil Chemist on 09.05.2002 and his junior was promoted only on 15.03.2007, the date of initial appointment of the petitioner was 23.03.1976 whereas his junior entered into service on 03.12.1975. Since the said Thirumalaivasan was senior to him in service and his pension was calculated from the date of entry into service, the said Thirumalaivasan was drawing higher pension. The third respondent rejected the representation sent by the petitioner seeking clarity in pay-scale and pension.

2. The reasons given by the third respondent are fair and genuine,

warranting no interference by this Court and the writ petition fails and the same is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
