ORDER

This Writ Petition has been filed challenging the impugned order, dated 21.08.2025 passed by the 4th respondent, rejecting the petitioner's application seeking for transfer of patta in her name for the property morefully described in the prayer to this writ petition.

2. The petitioner has challenged the impugned order on the ground that the same is a non-speaking order and has been passed in violation of principles of natural justice.

3. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents and on instructions, he would submit that the petitioner has challenged only the impugned communication, dated 21.08.2025 issued by the 4th respondent through Page No.2 of 6

whatsapp. He would submit that subsequent to the said communication, a final order, dated 10.01.2026 has been passed by the 4th respondent, which is a speaking order. Therefore, he would submit that the petitioner will have to challenge the same, if the petitioner is aggrieved by the said order, dated 10.01.2026 passed by the 4th respondent, before the concerned Revenue Divisional Officer.

4. The learned counsel for the petitioner, on instructions, would now submit that the petitioner is willing to prefer an appeal before the concerned Revenue Divisional Officer. However, she would submit that till date, the petitioner has not received the order, dated 10.01.2026 passed by the 4th respondent.

5. A xerox copy of the order dated 10.01.2026 passed by the 4th respondent has been served by the learned Special Government Pleader appearing for the respondents to the learned counsel for the petitioner in the open court today. The learned Special Government Pleader appearing for the respondents also submits that the original order, dated 10.01.2026 passed by the 4th respondent will be served on the petitioner through registered post.

6. It is made clear that the limitation period for filing an appeal by the petitioner, if she is aggrieved by the order, dated 10.01.2026 passed by the 4th respondent, starts running only from the date when the petitioner has received the original order.

For the foregoing reasons, this Writ Petition is disposed of by granting liberty to the petitioner to challenge the order, dated 10.01.2026 passed by the 4th respondent, rejecting the petitioner's application seeking for issuance of patta for the property morefully described in the prayer to this writ petition, by filing an appeal before the concerned Revenue Divisional Officer, within the limitation period. On receipt of the said appeal from the petitioner, the concerned Revenue Divisional Officer shall dispose of the said appeal, on merits and in accordance with law, and by adhering to the principles of natural justice, within a period of twelve (12) weeks from the date of receipt of the petitioner's appeal.
