J U D G M E N T

(Judgment of the Court was made by DR.G.JAYACHANDRAN, J.) The Civil Miscellaneous Appeal has been filed against the order passed in I.A.No.485 of 2017, filed under Section 24 of the Hindu Marriage Act, in O.P.No.3418 of 2012, which was a petition for divorce pending before the Family Court. In the said Interlocutory Application, the Family Court directed payment of a sum of Rs.7,000/- per month to the first petitioner/wife as interim maintenance. Aggrieved by the said order dated 08.08.2017, the present Civil Miscellaneous Appeal has been preferred.

2. It is now stated by the learned counsel appearing for the respondents that the main Original Petition filed for divorce has been dismissed. It is further submitted that the maintenance case filed in M.C.No.248 of 2021 before the V Additional Family Court, Chennai, under Section 125 of the Code of Criminal Procedure, was allowed, fixing Rs.10,000/- per month as maintenance. The said order passed in M.C.No.248 of 2021 has been confirmed by the Hon'ble High Court in Crl.R.C.No.1396 of 2025.

3. In view of the dismissal of the main Original Petition and the confirmation of the order passed in M.C.No.248 of 2021, whereby maintenance of Rs.10,000/- per month has been upheld, nothing survives for adjudication in this Civil Miscellaneous Appeal.
