Writ Appeal filed under Clause 15 of the Letter Patent Act, to allow this Writ Appeal by setting aside the Order dated 25.10.2025 passed by this Honble Court in W.P.No.39810 of 2025 and thus render justice. For Appellant :

Mr. R.Mohanaraja Judgment (Judgment of the Court was delivered by R.Suresh Kumar J.) This intra-court appeal has been directed against the order passed by the Writ Court dated 25.10.2025 made in W.P.No.39810 of 2025.

With regard to the fitment and pay disparity, in order to redress the grievance of the petitioner/appellant, he seems to have given a representation on 23.07.2014 to the respondent Bank/employer and the same though had been considered and rejected on 15.05.2015 of-course by a cryptic order and the same has never been questioned, till he superannuated in the year 2018. Even thereafter in the year 2025, he come out with the present writ petition seeking for a writ of mandamus to consider his representation dated 23.07.2014. The said writ petition has been dismissed through the impugned order on the ground of laches, as against which, the present appeal has been directed.

3. Heard Mr.R.Mohanaraja, learned counsel appearing for the appellant.

4. It is a fact that, the petitioner/appellant's representation dated 23.07.2014 having been considered was rejected by order of the respondent bank on 15.05.2015. Though it is a short and cryptic order, the same has not been questioned so far in the manner known to law by the petitioner/appellant. Only belatedly, the present writ petition has been filed in the year 2025 that too seeking for a mandamus unmindful of the rejection order dated 15.05.2015 therefore, the reasoning given by the learned Judge even for issuance of a mandamus on the ground of laches cannot be interfered with.

5. Accordingly, this writ appeal fails and is liable to be dismissed. Hence, it is dismissed. No costs.

However, liberty is granted to the petitioner/appellant to re-agitate the issue by challenging the order of rejection dated 15.05.2015 in the manner known to law and in that case, the laches issue would not stand in the way in pursuing such a legal course of action by the appellant.
