This Criminal Original Petition has been filed seeking a direction to the first respondent police to execute the Non- Bailable Warrant dated 10.06.2022 issued by the learned Metropolitan Magistrate, Fast Track Court No.III, Saidapet, in C.C.No.1187 of 2020.
The grievance of the petitioner is that he had instituted a case against the accused/respondents 2 to 5 before the learned Metropolitan Magistrate, Fast Track Court No.III, Saidapet, for the offences under Sections 138 & 142 of Negotiable Instruments Act, in C.C.No.1187 of 2020. Due to the non-appearance of the accused, the trial Court had issued a nonbailable warrant against them on 10.06.2022. However, despite the issuance of the warrant against the accused in the year 2022, till date, neither have the accused surrendered nor have the respondent Police secured them. Therefore, since no steps have been taken, the present petition has been filed.

Learned Government Advocate (Criminal Side) appearing for the respondent police submitted that though the Non-Bailable Warrant was issued on 10.06.2022, it was received by the first respondent police only on 10.06.2025. He further submitted that upon verifying the address mentioned in the warrant, it was found that the accused had left the place and were not available at the address mentioned by the petitioner. Therefore, a report to that effect was also sent to the Court concerned on 04.08.2025. 4.
Recording the submission made by the learned Government Advocate (Criminal Side), this Criminal Original Petition stands closed. However, the petitioner is at liberty to take fresh steps in accordance with law.
