PRAYER: Criminal Original Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, to direct the respondent police to execute the non-bailable warrant issued vide order dated 10.06.2022 against respondents 2 to 5 /accused in C.C.No.197 of 2020 pending before the learned Metropolitan Magistrate, Fast Track Court No.III, Saidapet within a stipulated time.

This Criminal Original Petition has been filed seeking a direction to the first respondent police to execute the Non- Bailable Warrant dated 10.06.2022 issued by the learned Metropolitan Magistrate, Fast Track Court No.III, Saidapet, in C.C.No.197 of 2020.
The grievance of the petitioner is that he had instituted a case against the accused/respondents 2 to 5 before the learned Metropolitan Magistrate, Fast Track Court No.III, Saidapet, for the offences under Sections 138 & 142 of Negotiable Instruments Act, in C.C.No.197 of 2020. Due to the non-appearance of the accused, the trial Court had issued a nonbailable warrant against them on 10.06.2022. However, despite the issuance 2/5
of the warrant against the accused in the year 2022, till date, neither have the accused surrendered nor have the respondent Police secured them. Therefore, since no steps have been taken, the present petition has been filed.
Learned Government Advocate (Criminal Side) appearing for the respondent police submitted that in C.C.No.197 of 2020, so far, the first respondent police have not received any warrant from the Court below. 4.
Recording the submission made by the learned Government Advocate (Criminal Side), this Criminal Original Petition stands closed. However, the petitioner is at liberty to take appropriate steps for issuance of a fresh warrant at the present address of the accused, in accordance with law.
