O R D E R

This Writ Petition has been filed seeking a direction to the 1st respondent herein to consider and pass orders on the petitioner's representation dated 01.11.2025, submitted for grant of retirement on medical ground due to disability, by considering the recommendation of the 2nd respondent in Na.Ka. No.8819/2020/e3 dated 24.07.2025. 2.The case of the petitioner is that he was appointed as a Fitter in the 2nd respondent Municipality. Due to his ailments from the year 2024, he started applying for medical leave with valid medical certificates from 24.05.2024. The 2nd respondent sent a letter dated 10.10.2024 to the Joint Director, Medical and Rural Health Services, Government Hospital, Kanchipuram, requesting a medical examination.

The Joint Director, Medical and Rural Health Services, Government Hospital, Kanchipuram, in turn issued letter dated 10.10.2024 to the petitioner directing him to appear for medical test. The 2nd respondent again sent a letter dated 19.11.2024 to the Joint Director, Medical and Rural Health Services, Government Hospital, Kanchipuram regarding the petitioner's medical test. On 24.12.2024, the District Medical Board, Joint Director of Health Services, Kanchipuram, issued the petitioner's medical report.

Kanchipuram sent a letter dated 10.01.2025 to the 2nd respondent herein stating that the petitioner is not fit to continue his duty as per his medical report dated 24.12.2024 and recommended to treat all his leaves as "Medical Leave".

2.01. In view of his medical inability and unfit condition, the petitioner submitted an application dated 13.01.2025 seeking VRS on the ground of his disabilities. The Regional Medical Board sent a call letter dated 20.02.2025 directing the petitioner to appear before the Regional Medical Board, Chennai on 14.03.2025 for medical tests. The Regional Medical Board issued a report dated 21.03.2025 stating that the petitioner suffered with multiple disorders and unfit to continue his duty and recommended to treat his leaves as "medical leave". Another representation dated 05.05.2025 was submitted by the petitioner to the 2nd respondent requesting VRS. A letter dated 24.07.

2025 was sent by the 2nd respondent to the 1st respondent seeking an order granting VRS in favour of the petitioner But, till date the 1st respondent has failed to consider the recommendation. Based on the recommendation of the 2nd respondent, the petitioner sent a detailed representation dated 01.11.2025 to the 1st respondent requesting to approve the VRS application. However, the same has not been considered till date.

3.The learned counsel for the petitioner would submit that it would suffice, if a direction is issued to the 1st respondent to consider the petitioner's representation within a reasonable time. 4.The learned Additional Government Pleader appearing for the 1st respondent would submit that they will consider the petitioner's representation and pass appropriate orders within a reasonable time to be fixed by this Court.

5.Considering the limited request made by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the 1st respondent to consider the petitioner's representation dated 01.11.2025 on merits and in accordance with law and pass appropriate orders, within a period of six (6) weeks from the date of receipt of a copy of this order,

6.With the above directions, this writ petition is disposed of. No costs.
