PRAYER: The Writ Petition is filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus directing the respondents to disburse the belated payment of interest amount of Gratuity, Earned Leave Salary and Commutation amounts but other unsettled benefits Arrears of Leave Surrender in while in service, 12(3) Settlement Arrears, Pension arrears and DA
Arrears with effect from 01.07.2018 within the stipulated time as may be fixed by this Court.

ORDER
This Writ Petition has been filed, to direct the respondents to pay interest for the belated payment of Gratuity, Earned Leave Salary and Commutation amount and other unsettled benefits, namely Arrears of Leave Surrender while in service, 12(3) Settlement Arrears, Pension arrears and DA arrears with effect from 01.07.2018, to the petitioner.

It is the case of the petitioner that the petitioner, who had joined the service of the respondent Corporation, had retired from service on 30.06.2018, however, the terminal benefits have been settled belatedly. Further, the other benefits, namely Arrears of Leave Surrender while in service, 12(3) Settlement Arrears, Pension Arrears and DA arrears have not been settled till date. Therefore, the petitioner claimed 6% interest on the belated payment of terminal benefits and other unsettled benefits and he has also made a representation on 22.09.2025 to pay interest for the belated payment of terminal benefits and other unsettled benefits which has not been evoked any response so far. Hence, the petitioner is before this Court.
3.Heard the learned counsels appearing on either side and perused the materials available on record.

In view of the limited request made by the petitioner with regard to interest on the belated payment of terminal benefits and other unsettled benefits, this Court directs the respondents to pay interest @ 6% for the belated payment of terminal benefits from the date of retirement till the date of actual disbursal of terminal benefits of the petitioner and other unsettled benefits, within a period of six weeks from the date of receipt of a copy of this order taking into account the bank rate of interest on deposits.
5. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
