ORDER

Today, when the matter taken up for hearing, the learned counsel for Revision Petitioner would submit that the Revision Petitioner was died. On seeing the prayer, he wanted to keep the plaint pending for the reason that the prayer sought in the plaint as such is not maintainable in law. The Court had also verified the prayer in the plaint. The objections raised on the side of Revision Petitioner is sustainable one, but however, as on date, the Revision Petitioner died. Liberty is granted to the legal heirs of the Revision Petitioner to approach the trial court and raise all their defence by filing an application for rejection of plaint under Order 11 Rule 7 of C.P.C. The 1st defendant also died. The Revision Petitioner is directed to take steps before the trial court. Accordingly, this Civil Revision Petition is disposed of. No costs.
