ORDER

The learned counsel for the petitioner/ 2nd decree holder preferred this revision seeking a direction to the learned II Additional District Judge to dispose of E.P. No. 45 of 2024 arising out of Arbitration Case No. 55 of 2018.

2. It is submitted that the arbitral award was passed on 08.06.2019 in A.C.No.55 of 2018. Even after passing of the award, the judgement debtor successfully dragged the proceedings for 6 years by filing several applications. Therefore, the petitioner has sought a direction from this Court for expeditious disposal of the execution proceedings. It is further submitted that as on date, the arbitration award has not been set aside and continues to be in force. Hence, the decree holder is entitled to execute the award.

3. Considering the above submissions, this Court deems it appropriate to issue a direction to the Executing Court. Accordingly, the Executing Court is directed to dispose of the Execution Petition in E.P.No. 45 of 2024, as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of this order.
