Respondents PRAYER: Criminal Original Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, to call for the records with regard to the final report in C.C.No.100 of 2025 on the file of the learned Additional Mahila Court, Udhagamandalam and set aside the same and consequently, transfer the investigation in Crime No.52 of 2024 from the 2nd respondent police to any other investigating agent for further investigation and to file the final report afresh.

When the matter was taken up for hearing today, the learned counsel appearing for the petitioner submitted that the second respondent has not conducted a proper investigation and that certain important provisions of law had been omitted, resulting in the filing of a defective final report. However, he sought permission of this Court to withdraw this petition and also made an endorsement to that effect. He further sought the indulgence of this Court, to grant liberty to the petitioner to raise all the grounds before the trial Court.

In view of the submission and the endorsement made by the learned counsel appearing for the petitioner, this Criminal Original Petition is dismissed as withdrawn. Consequently, the connected miscellaneous is closed. However, the petitioner is at liberty to raise all her grounds before the trial Court.
