ORDER

The petitioner was arrested and remanded to judicial custody on 26.11.2025 for the alleged offence punishable under Sections 296(b), 115(2), 118(1), 351(3) and 105 of BNS @ under Sections 296(b), 115(2), 118(1), 351(3) of BNS, in Crime No. 404 of 2025, registered on the file of the respondent, seek bail.

2. The allegation against the petitioner is that he is the son of the deceased. It is alleged that, as his parents refused to give him money for consuming liquor, the petitioner assaulted them with bricks and his hands, causing grievous injuries. As a result of the assault, the mother succumbed to the injuries, while the father survived. Hence, a complaint was registered against the petitioner.

3. Learned counsel appearing for the petitioner submitted that the petitioner, aged 28 years, is an innocent person and has been falsely implicated in this case. He further submitted that the petitioner is in judicial custody since 24.11.2025. Hence, he prayed for the grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that the petitioner has no previous criminal antecedents and that the investigation is still pending

5. Considering the submissions made by the learned counsel on either side, the fact that the FIR was registered recently, and that the investigation is still pending, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, the Criminal Original Petition is dismissed. 19.12.2025 drl 2/4
